Former Florida Supreme Court Justice Passes Away

Tallahassee, FL - December 30, 2012

Former Florida Supreme Court Justice Ben F. Overton died Saturday, December 29, in Gainesville, Florida, of complications from heart surgery. He was 86 and was Florida's 62nd Justice since statehood.

"Justice Overton was one of the most influential members of the Court after the sweeping reforms of the 1970s," said Chief Justice Ricky Polston. "He will be remembered not only for his far-seeing opinions but also for his efforts in the 1970s to make the state courts more accessible by allowing cameras into our courtrooms."

In the mid-1970s, Overton was one of several newly appointed Justices who elevated the reputation of the Court after it earlier had become involved in scandal. He was the first Justice chosen through a merit selection process created by Gov. Reubin Askew that soon was added to the Florida Constitution by vote of the people.

From his appointment on March 27, 1974, until his retirement on January 4, 1999, Overton authored more than 1400 decisions and was a central figure in a vast series of reforms that made his Court one of the most respected and accessible in the nation. He served as Chief Justice from 1976-1978 and chaired the Article V Review Commission in 1984.

He not only helped make Florida one of the first states to allow television coverage of court cases, but also was instrumental in making the state Supreme Court one of the first in the world to have a website. Overton later played a pivotal role in seeing that every Florida Supreme Court case was televised, webcast, and stored in an on-line archive.

Born in Green Bay, Wisconsin, Overton attended the University of Florida and later received his degree from its law school in 1952. He also earned an LL.M in jurisprudence from the University of Virginia in 1984.

Overton served nearly 10 years on the Pinellas County circuit court and, for several years, as its chief judge. He was well known for his work in legal education and dispute resolution and was Chairman of the Dispute Resolution Section of the American Bar Association. He was also an active adjunct professor of law at the University of Florida's Levin College of Law.

Predeceased by his wife Marilyn, Overton is survived by his children Judge William H. Overton, Robert M. Overton, and Catherine L. Overton; 2 grandchildren William E. and Brian H.; and one great grandchild, Adelynn.

Services will be held on Saturday morning, January 5, 2013 in Gainesville and Justice Overton will lie in state at the Florida Supreme Court on Monday, January 7, 2013. He will be interred in St. Petersburg, Florida on Wednesday, January 9, 2013.

Further details will be released when available.

Roberts urges full financial support for the court

WASHINGTON (AP) ? Urging full financial support for the U.S. court system, Chief Justice John Roberts said in his year-end report Monday that the federal judiciary, unlike executive branch agencies, does not have discretionary programs it can eliminate or projects it can postpone.

The judiciary has been doing its part to carefully manage "its tiny portion of the federal budget" and because the courts have already pursued cost-containment so aggressively, it will become increasingly difficult to economize further without reducing the quality of judicial services, said Roberts.

The chief justice's report came amid a New Year's Eve drama as President Barack Obama worked with Congress to avert the fiscal cliff. The White House and congressional Republicans agreed to block across-the-board tax increases set for midnight, but held up a final deal as they haggled away the final hours of 2012 in a dispute over spending cuts.

Virtually all of the judiciary's core functions are constitutionally and statutorily required, Roberts said in his year-end report.

"The courts must resolve all criminal and civil cases that fall within their jurisdiction, often under tight time constraints," said Roberts. "A significant and prolonged shortfall in judicial funding would inevitably result in the delay or denial of justice for the people the courts serve."

"I therefore encourage the president and Congress to be especially attentive to the needs of the judicial branch and provide the resources necessary for its operations," said Roberts.

In the just-ended fiscal year, the Supreme Court requested an appropriation of $75.6 million for judicial operations ? a 2.8 percent decrease from the previous year's $77.8 million. In the current fiscal year that began Oct. 1, the Supreme Court's appropriation request rose to $77.2 million, largely in response to new judicial security needs ? but still less than its fiscal year 2011 request.

In his report, Roberts said that for fiscal year 2014, the court will submit an appropriation request of $74.9 million ? a 3.7 percent decrease from its fiscal year 2011 request.

The chief justice said that in the 2012 fiscal year, the judiciary, including the Supreme Court, other federal courts, the Administrative Office of the United States Courts, and the Federal Judicial Center, received $6.97 billion in appropriations, representing "a mere two-tenths of 1 percent of the United States' total budget of $3.7 trillion."

NCRegister | Music With a Higher Purpose

Kevin and Monica Fitzgibbons founded De Montfort Music in 2012.

Their first CD release was Advent at Ephesus, featuring the Benedictines of Mary, Queen of Apostles, a contemplative community located in northwest Missouri.

The album debuted at No. 1 on Billboard magazine?s Traditional Classical Music Chart, besting the likes of Andrea Bocelli, Placido Domingo and the Mormon Tabernacle Choir. It stayed at No. 1 and concurrently went to No. 3 on Billboard?s new-artist chart, took the No. 1 spot on Barnes & Noble?s online ranking for all music and ranked No. 4 overall at Amazon.

In one sense, it was no surprise for the entertainment-industry veterans ? Kevin worked for Columbia Records/Sony Music in Los Angeles; Monica worked for DreamWorks, SKG.

In 2007, the couple walked away from their music-industry jobs and founded Aim Higher Media (De Montfort Music is a division of Aim Higher), aiming to bring Blessed John Paul II?s motto ? "Totus Tuus!" ? to the world through art and good entertainment.

With De Montfort Music (DeMontfortMusic.com), the Fitzgibbonses want to bring the very best in sacred music and chant to the world.

In early December, they talked about their faith and their work.

?

How did you two meet?

Kevin: Monica and I met while in New York, when we worked for Sony and Dreamworks. We started dating, found out we were both Catholic, and that was a good thing! While dating, we took another look at our lives, and both of us agreed we weren?t seeking the devout life as much as the "me" life. We slowly started coming back to the Church. The closer we got, the more we realized that if we were going to set our marriage on a solid foundation we couldn?t lead a double life anymore. Soon after our first child was born, we found ourselves walking more away from the secular side of the music business.

?

When you did that and founded Aim Higher Media in 2007, what was your goal?

Monica: We wanted to help artists, encourage them and make it be a positive art. It?s very difficult to get projects off the ground and things like licensing, and that?s what we?re trying to do. We had been involved in many projects in the past.

?

How did De Montfort Music evolve?

Monica: De Montfort Music came out of that (goal to make positive art). Kevin wanted to have a place for the religious orders to put their music out and not have to go directly to global entertainment companies. This gives them a good opportunity to have more ownership of their image and their music. Kevin came up with the great idea to have De Montfort Music so that these orders know they have a fertile haven for their music, but not let the world take too much of their life over. We?re the go-between between those two worlds.

The first project is the Benedictine Sisters? Advent at Ephesus. We gained a distribution deal through Decca, which is the largest classical-music distributor of that genre of music. It?s a wonderful collaboration. Our goal was to add into the culture some good and positive forms of entertainment not seen in recent times ? much like discovering a Michelangelo painting.

Kevin: One of the main reasons both Monica and I wanted to build De Montfort Music specifically around (religious) orders is that we felt these priories and monasteries are strong and vibrant. We met the Benedictines of Mary and saw how absolutely perfect their singing was ? it?s some of the most beautiful music you?ll hear, a slight view into heaven. It deepened our commitment of what we wanted for De Montfort Music.

?

How did you come to name your company after a saint?

Kevin: Our journey started with a very dear friend of ours, who was kind enough to educate us and to answer a lot of our questions. Out of these conversations, we were introduced to the book Aim Higher: Spiritual and Marian Reflections of St. Maximilian Kolbe by St. Maximilian Kolbe. That?s why we named the company Aim Higher.

His deep devotion to Our Lady led us to St. Louis de Montfort and his book that I got for a gift for Christmas for Monica, True Devotion to Mary. That book and St. Maximilian Kolbe led to consecrating ourselves to Our Lady and the enthronement of our home to the Sacred Heart.

?

How did the enthronement come about?

Monica: It was a book by Cardinal Raymond Burke, The Enthronement of the Sacred Heart of Jesus. We were very young in our family life, and, really, Cardinal Burke thought of everything. It?s a school, a way to walk you through the enthronement of a family. Kevin, being head of the domestic church, said that we should do this enthronement.

I had been a working woman in the world and around celebrities. To go from that to being a wife and mother and really letting someone else take the lead in the household, I didn?t even realize that was important. Kevin was to be the head of our domestic church.

I really do believe that enthronement brought us together in our marriage and our domestic church. Nothing has been as profound as this home enthronement, as carried out by Cardinal Burke?s book.

Kevin: It also encouraged me to go out and introduce myself to our pastor, join the Knights of Columbus, do the consecration to Our Lady and start Eucharistic adoration. A nice relationship developed with our pastor.

Monica: We never had a priest in our home because we didn?t feel we were holy enough. We had so much respect we didn?t want to burden them. But there?s no way to do this home enthronement effectively without a priest.

?

You specifically mention John Paul II?s motto ? "Totus Tuus" ? in relation to your company. How did he influence you?

Kevin: We noticed his love of Our Lady. And we noticed another thing: We had been working with rock stars, actors and famous people in the entertainment industry. In the world of live performance, that immediate feedback is very tempting ? our temptation to pride. When we saw John Paul II, we saw him up there with thousands of people in the audience, who were calling out, "John Paul II, we love you!" We were always wondering: How did he remain so humble? How did he do it (the constant humility)?

We learned more about his devotion to Our Lady. It?s the whole miracle of Our Lady of Fatima: Who among us can say we took a bullet for Our Lady?

Monica: How does someone get that way? That "Totus Tuus" is a big clue. You?ve got to know his devotion to Our Lady. That?s the secret of his success, and that?s what we discovered.

?

I understand you also had a saint connected with the album.

Monica: We tell people St. Th?r?se the Little Flower and St. Francis of Assisi are also on the CD. Their first-class relics were standing between Mother Cecilia, singing and conducting, and the choir of the sisters.

A lot of the proceeds are going to the sisters. They have the great "problem" of a growing order, and along with that comes debt. One of the other reasons we?re doing this (with De Montfort Music) is that we want to help relieve their debt. They?re all very young; it?s a very beautiful endeavor to support. If you buy the CD directly from the sisters? website (BenedictinesofMary.org), they get a little extra. They are praying to the Little Flower to help them with this.

?

St. Th?r?se had several sisters who were nuns as well. How many children do you have?

Kevin: Five. The oldest is 9; then 7, 6, 4 and 1; two boys and three girls.

Monica: We pray they all have religious vocations.

(AP) ? Geno Auriemma insists long winning streaks do little to get him amped up, even after he traveled his Connecticut team across the country to face top-ranked Stanford and its daunting 82-game unbeaten run at Maples Pavilion.

The Huskies sure got a thrill from leaving with an unexpected rout and silencing a typically raucous crowd ? and likely stealing away the No. 1 spot in the polls along with it.

Kaleena Mosqueda-Lewis and second-ranked UConn played spoiler and streak-buster this time, snapping Stanford's nation-leading home winning streak with a surprisingly easy 61-35 victory Saturday.

It was the Huskies who saw the end of their NCAA record 90-game winning streak at Maples Pavilion with a 71-59 loss two years ago, almost to the day on Dec. 30.

"The last time we were here it was a big event for them and they treated it like it was a big event, and God bless them," Auriemma said. "But for us to win a game here in late December, it's no more than just a big game against a really good team. The other stuff, I didn't get all that excited about us winning 90, I'm not going to get that excited about us beating somebody who's won 82 in a row at home."

Mosqueda-Lewis scored 19 points as UConn (11-0) thoroughly outplayed Stanford (11-1) on both ends of the floor in this highly touted game featuring the country's top programs and Final Four regulars from opposite coasts.

Stanford got harassed right off the home floor that it ruled with perfection and dominant play for nearly six years ? and the Huskies surely took the Cardinal's No. 1 spot along with it.

The game was the 51st meeting between the top two teams in the poll. The No. 1 seed had won the previous nine matchups and holds a 31-20 lead.

Chiney Ogwumike had 18 points and 13 rebounds but struggled in the post as Stanford lost at home for the first time since March 2007.

"It was a bad day. Whatever we were trying to do, we really struggled with it," Stanford coach Tara VanDerveer said. "Connecticut came in here on a mission. Mission accomplished."

Stefanie Dolson had 10 points and 14 rebounds and flustered Ogwumike all afternoon, and Bria Hartley and Kelly Faris also scored 10 apiece for UConn.

Breanna Stewart scored seven straight points during a decisive 17-2 run in the first half as UConn built a 22-7 lead against the cold-shooting Cardinal and kept the pressure on the rest of the way.

Stanford trailed 31-13 at halftime in one of its worst 20 minutes in recent memory ? though the school had no record of when the Cardinal were last held to that few points in a half.

They had gone five full seasons with an unbeaten record on their home floor.

Mosqueda-Lewis, last season's Big East top freshman averaging 16.4 points and 5.0 rebounds, shot 7 for 13 as Connecticut shot 37.5 percent from the floor ? and that was plenty good enough against a Stanford team that wound up at a dismal 19.3 percent (11 for 57) in its lowest single-game shooting performance and fewest field goals made.

"I love the game, I think it's a great game for both teams, but for our game two years ago it was a national event ? I don't think tonight was a national event," Auriemma said. "We beat a really good Stanford team on their home court and they happened to have won a lot of games at home."

Stanford had four early possessions over the opening 4 1/2 minutes in which it faced a dwindling shot clock.

This wasn't the Cardinal's worst home loss ever ? that was a 96-51 defeat to Long Beach State on March 10, 1983 ? though UConn sure made it feel like it for an afternoon to silence a typically animated crowd.

Auriemma was booed by the crowd during pregame introductions, then again when the coach was whistled for a technical foul with his team ahead 19 points with 13:22 remaining.

UConn, which had trailed for only 48 seconds all season coming into the game and now just 2:21 in all, won for the first time at Stanford in four tries.

Ogwumike, Stanford's leading scorer and rebounder averaging 21.8 points and 12.8 boards, was held to 6-for-22 shooting.

"I don't think I've experienced anything like this," Ogwumike said. "That Connecticut team we played for 40 minutes is the standard. And the great thing is now we've experienced the standard."

UConn's 6-foot-5 Dolson made things tough all day for Ogwumike ? who stands 6-4 ? and gave her problems with a size advantage to deny Stanford's top player and keep her away from the basket. That led to some forced shots in the first half, when Ogwumike missed 8 of her first 9 attempts. She scored at the 7:25 mark of the first half to end a nearly 6-minute scoring drought since her previous basket on a putback at 13:19.

Stanford then went 4:58 without scoring before Ogwumike's three-point play 2:27 before halftime.

"Stefanie was going to guard Chiney until she proved that she couldn't," Auriemma said.

Dolson was whistled for her third foul with 17:42 left in the game, but Mikaela Ruef missed both free throws.

Walking off the court after this one "was complete opposite," Dolson said.

"Two years ago we lost and it ended our streak. It was just a horrible loss," she recalled.

Bonnie Samuelson's back-to-back 3-pointers midway through the second half, the Cardinal's first from behind the arc, gave them some life. But it was short-lived as the Huskies pulled away.

Stanford's 82-game home winning streak dated to a 68-61 loss to Florida State in the second round of the NCAA tournament on March 19, 2007.

This season's Cardinal stunned defending NCAA champion and then-top-ranked Baylor and Brittney Griner on Nov. 16 to become the nation's No. 1 team and avenge a loss in last spring's NCAA semifinals.

The Cardinal hardly looked like the best team Saturday against the dominant Huskies. They were held below 40 points for the first time since a 72-32 loss to Missouri on Jan. 2, 1984.

Stanford missed its initial 10 3-point tries and began the game 3 for 22 to fall behind 22-7, with UConn getting three quick 3s.

Ogwumike's big sister, Nnemkadi ? the 2012 No. 1 overall WNBA draft pick of the Los Angeles Sparks ? attended the game, along with other former Stanford players Rosalyn Gold-Onwude and Lindy La Rocque.

Stanford senior Joslyn Tinkle, the team's second-leading scorer, managed only two points while playing on her 22nd birthday.

Internet Business Mastery ? 3 Reasons Why Prospects Want to Get ...

Wow, take it easy folks! I mean professionally here. Internet business mastery is about influencing prospects to get in bed with you, to partner with you and to make money online with you. People commit and both parties rock it out. Attraction is the end goal. You stalk no prospects like a mad dog, nor do you chase, or attack individuals. You lay out delectable bread crumbs and the rest is history. People have no choice but to gobble up your content and partner with you in due time.

Internet Business Mastery

Reason 1 ? Your Content Is Delicious

You write a blog post solving some problem: how to generate network marketing leads, for example. People experiencing the problem read your post. The crowd gets excited! Now, they put your knowledge into use and begin to generate network marketing leads. This is delicious content. This content creates testimonials, or team members. This content helps you make money online. Put out the best content to shack up ? or partner up ? with perfect matches.

Reason 2 ? You Create Like a Machine

Hey Ryan how in the hell do you post 10 or 14 times to your blogs each day? Really what do you use PLR or a ton of guest posts or what? Yeah I want to work with you. Yeah I will do a testimonial for you without you even asking for one. I get these people in bed?.ok we become friends?.because I created like a machine. Oh by the way, the answer to the above questions: I am a hungry son of a bitch who wants to grow my internet businesses so I make no lame excuses and write 10 to 14 posts a day.

Reason 3 ? You Are Trusted

You can create content and solve problems but trust is another story. You must appear to be real to the online business crowd. Set up social networking accounts on Facebook and Twitter. Post pictures of yourself ? this one drives me nuts ? because unless you do, making connections is difficult. You are you, a human being. When people read your insightful comment and see a picture of a dog, or branding image, the connection is lost. Trust is lost. Post pics of you and share your story to make money online.

The Sultry Secret

Whether you run a network marketing team, an affiliate marketing business or any home based opportunity you need to bring something to the table to shack up with people. You cannot get what you want unless you give freely of your time and talents. Study your craft, create daily, be transparent and you can partner with prospering internet business entrepreneurs today.

By showing that tiny particles injected into a liquid crystal medium adhere to existing mathematical theorems, physicists at the University of Colorado Boulder have opened the door for the creation of a host of new materials with properties that do not exist in nature.

The findings show that researchers can create a "recipe book" to build new materials of sorts using topology, a major mathematical field that describes the properties that do not change when an object is stretched, bent or otherwise "continuously deformed." Published online Dec. 23 in the journal Nature, the study also is the first to experimentally show that some of the most important topological theorems hold up in the real material world, said CU-Boulder physics department Assistant Professor Ivan Smalyukh, a study senior author.

The research could lead to upgrades in liquid crystal displays, like those used in laptops and television screens, to allow them to interact with light in new and different ways. One possibility is to create liquid crystal displays that are even more energy efficient, Smalyukh said, extending the battery life for the devices they're attached to.

The research was funded in part by Smalyukh's Presidential Early Career Award for Scientists and Engineers, which he received from President Barack Obama in 2010. And the research supports the goals laid out by the White House's Materials Genome Initiative, Smalyukh said, which seeks to deploy "new advanced materials at least twice as fast as possible today, at a fraction of the cost."

Smalyukh, postdoctoral researcher Bohdan Senyuk, and doctoral student Qingkun Liu set up the experiment by creating colloids solutions in which tiny particles are dispersed, but not dissolved, throughout a host medium. Colloids are common in everyday life and include substances such as milk, jelly, paint, smoke, fog and shaving cream.

For this study, the physicists created a colloid by injecting tiny particles into a liquid crystal a substance that behaves somewhat like a liquid and somewhat like a solid. The researchers injected differently shaped particles that represent fundamental building-block shapes in topology. That means each of the particles is distinct from the others and one cannot be turned into the other without cutting or gluing. Objects that look differently can still be considered the same in topology if one can be turned into the other by stretching or bending types of "continuous deformations."

In the field of topology, for example, an object shaped like a donut and an object shaped like a coffee cup are treated the same. That's because a donut shape can be "continuously deformed" into a coffee cup by indenting one side of the donut. But a donut-shaped object cannot be turned into a sphere or a cylinder because the hole in the donut would have to be eliminated by "gluing" the sides of the donut back together or by "cutting" the side of the donut.

Once injected into a liquid crystal, the particles behaved as predicted by topology. "Our study shows that interaction between particles and molecular alignment in liquid crystals follows the predictions of topological theorems, making it possible to use these theorems in designing new composite materials with unique properties that cannot be encountered in nature or synthesized by chemists," Smalyukh said. "These findings lay the groundwork for new applications in experimental studies of low-dimensional topology, with important potential ramifications for many branches of science and technology."

U.S. poised to go off "fiscal cliff": Senator Reid

WASHINGTON, Dec 27 - Senate Majority Leader Harry Reid on Thursday warned that the United States looks to be headed over the "fiscal cliff" of tax hikes and spending cuts that will start next week if squabbling politicians do not reach a deal.

Reid, the top Democrat in Congress, criticized Republicans for refusing to go along with any tax increases as part of a budget remedy as he sketched out a pessimistic outlook.

"It looks like that is where we're headed," Reid said of the likelihood of the U.S. economy going over the "fiscal cliff" - with tax increases on most working Americans and automatic spending cuts kicking in next month.

Reid made his comments in a Senate floor speech at the opening of a post-Christmas session, adding that time was running out ahead of a December 31 deadline to act to avert the "fiscal cliff."

Reid urged House of Representatives Speaker John Boehner, the top Republican in Congress, to bring his chamber back into session and to avoid the biggest impact of the "fiscal cliff" by passing a Democratic-backed bill extending low income tax rates for all Americans except those with net household incomes above $250,000 a year.

House Republicans are expected to hold a telephone conference call on the fiscal cliff on Thursday afternoon, a House Republican aide said, adding that a schedule for returning to Washington would be discussed.

Should Congress fail to act by December 31, tax rates for all Americans would snap sharply higher, back to pre-2001 levels, and two days later, $109 billion in automatic spending cuts would start to take effect. Together, the higher taxes and lower spending would suck about $600 billion out of the U.S. economy, potentially causing a new recession in 2013.

On Wednesday, it was Boehner who urged the Democratic-controlled Senate to act first to avoid the fiscal cliff, offering to at least consider anything that the Senate produced.

Reid returned the volley on Thursday, saying that the Senate had already acted, and the Democrats' solution needs the consent of both Boehner and Senate Republican Leader Mitch McConnell.

Reid said Boehner "has just a few days left to change his mind" on the Senate bill. "I don't know time-wise how it can happen now."

How Can I Get My Unresponsive Friends to Actually Return My Messages?

How Can I Get My Unresponsive Friends to Actually Return My Messages?Dear Lifehacker,
I have a friend who sometimes doesn't reply to my emails, voicemails, or even texts. Or if she does, it takes ages. Is there any way to ensure she'll respond to them?

Signed,
Annoyed by No Replies

Dear Annoyed,
That sort of thing really bugs us too. We all have that friend or family member who's so impossible to get a hold of it feels like you're getting the cold shoulder. Assuming your friend isn't actually mad at you for some reason and wants to stay your friend, there may be a few ways to get your messages delivered?and responded to promptly (without feeling like a pest).

Make Sure You Send Your Messages at the Best Time for the Recipient

How Can I Get My Unresponsive Friends to Actually Return My Messages?

One possible reason why your friend never hits the reply button is simply the time you usually send your messages. If you friend is in school at night, for example, it's really easy for any late messages to go completely unnoticed?or opened and then forgotten about because she didn't have time to respond at that very moment. My family members tend to call me right at the start of my workday (for a reason I still don't understand), so, similarly, I end up leaving those calls to voicemail even though I would like to talk to them?later.

If you're sending an email, email marketing firm GetResponse analyzed 21 million email messages to find the best hours for sending emails (if you want them opened). Because the majority of emails land in the inbox in the morning, they say those sent in the afternoon have a greater chance of being opened and clicked on. Depending on the recipient, you probably should avoid sending emails during rush hour, child-bathing hour, and dinner time. Photo by GetResponse

Takeaway: If you want your messages to get more attention, try sending them when you know the person is least busy, if possible.

Some Types of Messages May Be Better Than Others

How Can I Get My Unresponsive Friends to Actually Return My Messages?Similarly, you should send your messages in the best medium for the person. People who don't have their phones with them all the time can't be expected to quickly respond to all text messages. An avid Facebook or Twitter user, on the other hand, might reply more readily to a message on one of those social networks than, say, email. Photo by Ian Lamont

Even those who try to respond to all messages in a timely fashion (e.g., with the 2-2-2 rule) put email as a lower priority than texts, which is beneath phone calls. I'm not sure what the official stance is on IM priority, but I might put that above even phone calls.

If you are sending an email, though, you can boost its chances of being read and replied to if you follow good email etiquette: Keep your email concise (3-5 sentences if possible), be as descriptive as possible in the subject line (a killer subject line helps), remind the person of any previous conversations in case he/she has forgotten them, and make your request as direct and explicit as you can. Short and sweet?yet still complete?works for all other message media as well.

Resend the Message

Maybe your friend just needs a nudge. Whether she forgot about the message or it never actually went through (sometimes spam filters can be overzealous), if the message is important, go ahead and resend it, saying something like "I wasn't sure if you got this, so I'm following up to see what you thought."

Ask for a Reply

Also, if you want a reply, make sure you explicitly ask for it. "Let me know either way" is the one line you definitely should add in your job interview followup letter and it works for other emails as well. Or you could say "What do you think?" or "Please let me know if you're interested or not." Even better: "I need to buy the tickets by noon tomorrow, so if I don't hear from you before then, I'll assume you're not interested."

Get a Mutual Friend to Intervene

How Can I Get My Unresponsive Friends to Actually Return My Messages?Someone else might be able to get your friend's attention better than you could. Don't be offended?perhaps they're just closer or more regularly in contact. If you have a mutual contact, you could say, hey, I'm having a hard time getting in touch with so-and-so, could you forward my message for me?

(As a final resort, if you're really desperate to get in contact with someone, you could spoof caller ID. As mentioned previously, though, you should only use Caller ID spoofing in an emergency case, because once your friend answers and finds out you are masquerading as someone else, it had better be worth it.) Photo by xrayspx

Don't Assume the Worst

Finally, your friend probably doesn't know she's annoying you, so try to give her the benefit of the doubt and not be too infuriated by this (admittedly annoying) behavior. You could also talk to her about why your messages aren't being returned. Something as simple as "Hey, did you get my last emails/texts/calls? This seems to happen a lot, and I know you're busy, so what's the best way to get in touch with you and when?" could go a long way towards mending the situation.

Love,
Lifehacker

Great Suggestions To Propel Your Social Media ... - Maynas Eric

Running an Internet business can be complicated, because something new is always popping up. New sites, new methods, and new players keep the marketplace interesting but the constant change can be intimidating. Using social media sites to market, for example, is the latest method of communicating with new customers, but you must learn the ropes first. Here are some great tips so you?re in the know on social media marketing.

YouTube can be a valuable social media marketing tool. YouTube works great to attract new people to your website, because your posted videos have already provided them with a preview of what you have to offer. This will increase the chances that visitors will make purchases.

Use the greatest number of media outlets possible to make the most of social media when marketing a service or product. Though Facebook is perhaps the best known vehicle, you should never disregard the potential of other sites including Twitter and Myspace. The more people that see you, the more you are likely to benefit from the exposure.

TIP! If you run a blog for your business, allow readers to retweet the content easily via a button included with each posting. This makes it much easier for other people to share your the content through twitter.

Utilize tools like Twellow or Tweepi that are related to Twitter. These tools help to pinpoint all of the people who can have a positive impact on your site. They will allow you to pinpoint which people or companies you should follow, so that they will notice you and follow your content, too.

Contests and giveaways are a proven strategy for pulling people to your product on Facebook. Your products can be awarded as a winning prize to those who win the contests you hold. This gives back to your followers, while marketing your company at the same time.

Your social media pages should have buttons all over. In addition, an RSS feed that provides all your updates is a good thing to have. Make this stand out on your blog, website, emails and also signatures whenever you leave a comment on the internet. This really gives the look and feel of a legitimate social user and not just a cold, dry business. Make sure you also take the opportunity to link everything together into a fluid network.

TIP! If you do not want to offend your social media fans, avoid putting up any content that is really personal or even remotely political. You want your customer to feel connected to you through your voice and personality, but you also want them to feel comfortable doing business with you professionally.

Set up an automatic tweet for every post you make to your Internet blog. With this in mind, choose a few quality bloggers and use the Twitter API to automatically tweet links to any new posts they make. These bloggers will enjoy the exposure, and your readers will appreciate the new content.

Make it nearly impossible for readers to not click through to your site by using creativity in your titles. Good titles encourage readers to notice and view your marketing content.

TIP! Help yourself be seen as a well educated professional in your field. This will really help you create a steady supply of business online.

When hiring a company to help you market with social media, make sure that the company uses two-way communication. Once you have verified that they are capable of understanding this, you will feel more comfortable using them to engage your target audience. Look at their existing social media pages ? how do their clients feel about them?

If you apply the suggestions in this article, social media marketing can be effective and enjoyable. Try several techniques, and determine which ones are most effective for your business. The Internet offers many effective ways to attract and connect with customers. It is important to stay up to date, and be the first to utilize new online marketing strategies. If you want your business to boom, take advantage of social media.

Consumer sentiment weakens as fiscal crisis looms

WASHINGTON (Reuters) - Consumer confidence fell more than expected in December, hitting a four-month low as a looming fiscal crisis sapped what had been a growing sense of optimism about the economy.

Other data on Thursday showed the number of Americans filing new claims for unemployment aid fell last week to nearly its lowest level in 4 1/2 years, while new home sales last month hit their highest level since April 2010.

The Conference Board, an industry group, said its index of consumer attitudes fell to 65.1 from 71.5 in November.

Gauges of business sentiment have weakened recently on worries about $600 billion in tax hikes and government spending cuts scheduled for early January. Now consumers also appear apprehensive, a sign worries about the so-called "fiscal cliff" could bite into household spending.

"People are hearing about (the cliff) and it negatively impacts confidence and investor sentiment and even holiday sales," said Todd Schoenberger, managing partner at Landcolt Capital in New York.

Also, with business sentiment weakening in recent months as the fiscal cliff has approached, many economists think hiring may remain sluggish even as the pace of layoffs ease.

The Labor Department said initial claims for state unemployment benefits dropped 12,000 to a seasonally adjusted 350,000, the Labor Department said. That was lower than analysts' forecasts for 360,000 new claims last week.

"This recent improvement in the claims data is potentially a favorable signal for the labor market," said Daniel Silver, an economist at JPMorgan in New York.

After spiking in the wake of a mammoth storm that ravaged the East Coast in late October, the weekly levels of new claims have now dropped to their lowest levels since the early days of the 2007-09 recession. The four-week moving average fell 11,250 last week to 356,750, the lowest since March 2008.

The claims data for last week has no direct relation to the Labor Department's monthly employment report, but suggests the surge in layoffs since the recession has at least run its course.

Companies in recent months have been adding to their payrolls at a lackluster pace, and analysts expect the monthly employment report due on January 4 will show 143,000 jobs created in December, down from 146,000 in November.

Analysts said the holiday season can make it more difficult to seasonally adjust the claims data, another reason to be cautious.

"There is usually a high margin of error in predicting the monthly payroll number," said Michelle Meyer, senior economist at Bank of America Merrill Lynch at New York. "That's even more the case this month from the residual effects of the hurricane and year-end seasonal adjustments," she said.

U.S. stocks opened flat, while longer-dated U.S. Treasuries rose after the data and after Senate Majority Leader Harry Reid said it was unlikely a budget deal would be reached before year end.

Following a truncated holiday break in Hawaii, U.S. President Barack Obama has returned to Washington to restart negotiations to avert the fiscal cliff, which if not averted would likely put the U.S. economy back into recession.

The signs of progress in the claims data also included a caveat, at least for the latest week.

Obama declared Monday a holiday for federal workers and many state offices followed suit and were unable to provide complete data for last week's jobless claims. Data for 19 states was estimated, a Labor Department official said.

Fourteen of those states, including Texas and California, submitted their own estimates, which tend to be fairly accurate because the state officials work with a significant amount of data, the Labor Department official said.

Analysts said the holiday season was another reason to be cautious about the report's positive tenor. Also, with business sentiment weakening in recent months as the fiscal cliff has approached, many economists think businesses are holding back on hiring.

"A significant improvement in labor market conditions ahead of any resolution to the fiscal cliff is unlikely," said Michael Gapen, an economist at Barclays in New York.

Separately, the Commerce Department said new U.S. single-family home sales accelerated in November to a 377,000-unit annual rate while the median sales price jumped 14.9 percent from the same month in 2011, signs that the U.S. housing recovery is gaining some steam.

In a fourth report, the Chicago Federal Reserve said its index of factory activity in the U.S. Midwest increased in November to 93.7 from a revised 92.2 in October.

LG?s latest projector system is powered by freaking lasers

3 hrs.

Until now, all consumer front projector systems?produced light using lamps or in rare cases LEDs. The new?LG HECTO FP system, on the other hand, uses lasers for illumination instead. Yes, lasers.

As LG announced on Wednesday, the new projector system uses lasers and a Texas Instruments DLP chip to form images. Typical home front projectors require around a 9 to 12 foot distance from the lens to a 100-inch screen. The LG HECTO requires only a 22-inch throw to fill the screen and can be placed on the floor or the mounted to the ceiling.

The LG HECTO Laser Projection TV will be sold as a complete system with a 100-Inch diagonal screen, a built-in ATSC TV tuner, HDMI switching and a Wi-Fi connection for streaming video.

Specifications include a rated 1,000,000:1 dynamic contrast ratio, 1080p resolution, 3 HDMI inputs, an optical audio input, RS-232 interface. Audio is produced by two 10W built-in speakers. The projector measures 5.7-inches high. The HECTO Laser projector does not have 3-D capability. LG has not? provided a brightness rating, a key specification. (Lasers offer the promise of very high intensity using low power.)

The screen is a fixed design and unlike theater screens its surface is black not white. LG claims the system will render a vivid, high contrast crisp image, even in lighter viewing environments.

The Laser TV supports LG's Smart TV platform and will stream movies via Netflix?and?YouTube as well as other services and?apps via its built-in Wi-Fi wireless Internet connection. The HECTO also includes LG's latest Magic Remote control.

LG claims its laser based illumination system has a lifespan of up to 25,000 hours, which is 5 times or more the life of traditional mercury-based lamps.

The LG HECTO Laser projector will be demonstrated at the 2013 International Consumer Electronics Show early next month. We expect pricing and availability to be announced at the show.

Make sure suspension policies apply equally to all ? Business ...

Sometimes, when investigating serious charges against an employee, it?s best to temporarily suspend him. If you use this approach, always do so uniformly and apply the same rules to similarly situated workers. Don?t, for example, suspend some with pay and others without.

Recent case: Benjamin, who is black, worked for a school district. When a license became necessary, Benjamin?s was held up by an investigation of potential wrongdoing. The allegations proved unfounded and he got the license.

The school district, however, wanted to conduct its own independent investigation and suspended him without pay for months.

Benjamin sued, alleging discrimination. He showed that white and female employees were almost always suspended with pay during investigations. A court said that was enough to warrant a trial. (Johnson v. Alice Independent School District, No. C-12-170, SD TX, 2012)
